Terms for using Fourth Health

Fourth Health Terms of Service

The short version

These Terms are an agreement between you and Fourth Labs, LLC ("Fourth Health," "we," "us," or "our"). They govern your use of the Fourth Health website and app.

A few points matter most:

  • Fourth Health is an organizational tool, not medical care. It does not diagnose, treat, prescribe, or replace your care team.
  • Do not rely on Fourth Health as your only reminder for medications, feeding, monitoring a symptom, or responding to an emergency.
  • Nell is an AI assistant and can be wrong. Review its responses and any proposed action before relying on or confirming it.
  • Household information is shared with the people the household invites. Private Nell conversations remain private unless the account owner deliberately shares a separate signal or plan.
  • Account, household, care, and payment roles are separate. The person who creates a household is not necessarily the mother, primary caregiver, or future subscription purchaser.

1. Accepting these Terms

By creating an account, clicking an acceptance control, or using Fourth Health, you agree to these Terms. If you do not agree, do not use the service.

You must be at least 18 years old and located in the United States. You represent that information you provide is accurate and that you have the authority required to provide it.

2. Fourth Health is not medical care

Fourth Health helps adults record and organize pregnancy, postpartum recovery, infant care, and household support. It is not a healthcare provider, medical device, emergency service, or substitute for professional judgment.

  • Nothing in Fourth Health is medical advice, diagnosis, or treatment.
  • Educational content is general information and may not apply to you or your baby.
  • We do not clinically verify user-entered information.
  • No provider-patient relationship is created by using Fourth Health.
  • Always consult an appropriate healthcare professional about symptoms, medication, feeding concerns, or other health decisions.

Do not rely on reminders or timers alone

Timers, schedules, notifications, summaries, and medication records can be delayed, unavailable, incomplete, or wrong. Maintain another reliable method for time-sensitive care and follow instructions from your healthcare professionals.

Emergencies

If you think you or a child may be having a medical emergency, call 911 or go to the nearest emergency room. Do not wait for Fourth Health or Nell.

If you are having thoughts of harming yourself or a child, call or text 988, call 911, or go to an emergency room.

3. Nell and AI-generated information

Nell is an AI assistant designed to help organize information, explain general concepts, prepare questions for a care team, and propose limited actions within Fourth Health.

Nell is not intended or authorized to:

  • Diagnose a condition or determine that a symptom is harmless
  • Prescribe medication or recommend starting, stopping, or changing a dose
  • Replace a healthcare professional or emergency service

AI systems can produce inaccurate, incomplete, unexpected, or outdated information. If a response appears to diagnose, prescribe, or conflict with professional advice, do not rely on it.

Nell may use relevant household information and private planning context as described in our Privacy Policy. Nell may also propose changes to a tracker or plan. You are responsible for reviewing a proposed action before confirming it. Fourth Health may retain an action record for reliability, security, and audit purposes.

Nell may create a derived mood or recovery signal. The underlying chat remains private. Such signals are shared with household members only when the account owner explicitly enables signal sharing.

4. Accounts and security

You are responsible for maintaining access to the email address used for your account and for activity performed through your account. Notify support@fourth-health.com if you believe an account has been accessed without authorization.

Do not share a sign-in code or secure invitation link with anyone who should not have access. We may require identity or authority verification before fulfilling sensitive account, household, or privacy requests.

5. Households and roles

Fourth Health uses a household to organize shared care. The relevant roles may include:

  • Account holder: the adult who controls an individual Fourth Health account
  • Household administrator: an adult authorized to manage household membership and settings
  • Care role: how a person participates in care, such as mother or birthing parent, partner, grandparent, family member, doula, nanny, or other helper
  • Subscription purchaser: the person associated with a future paid subscription, who may be different from the household administrator or care recipient

One person may hold several roles, but Fourth Health does not assume that the household creator is the mother, primary caregiver, or payer.

Shared access

An invited household member may see sensitive shared information, including care logs, medications, schedules, care-team information, meal photos, and child information. Invite only people who should have that access.

  • Removing a member stops future access but cannot undo information they already saw or independently saved.
  • Private Nell conversations and private working plans are visible only to their account owner.
  • A separately shared plan or explicitly shared Nell signal may be visible to household members.
  • Household members may add or correct shared records where the product permits.

Inviting someone

When inviting someone, you confirm that you have a reasonable basis to provide their contact information and that they would reasonably expect the invitation. Invitation links are sensitive and should be sent only to the intended person.

Information about a child

The household administrator who establishes a child's record confirms that they are the child's parent or guardian or otherwise have authority to create and share that record. Other household members confirm that they are participating at the invitation and direction of an authorized caregiver.

6. Your responsibilities and acceptable use

You may not:

  • Record another person's health information without appropriate authority or permission
  • Access or attempt to access another household without authorization
  • Probe, test, bypass, or interfere with Fourth Health's security
  • Upload unlawful content or content you do not have the right to use
  • Use Fourth Health to provide unlicensed medical care or imply that Fourth Health approved something clinically
  • Reverse engineer, scrape, copy, or use automated means to access the service except where law permits or we agree in writing
  • Place unreasonable load on the service or use it to harm another person

We may restrict or suspend access when reasonably necessary to protect users, comply with law, investigate misuse, or enforce these Terms.

7. Your content and shared records

You retain rights you have in information you contribute. You give Fourth Labs a limited license to host, store, process, display, and transmit that information as needed to operate, secure, and improve the requested service, including household sharing and Nell processing.

Household records may combine contributions from several people. Deleting an individual account does not necessarily delete shared records that other household members rely on. Where appropriate, Fourth Health may preserve a shared record while removing or minimizing the departing member's identifying information. Private conversations and private working plans are not treated as shared household records.

This license ends when the information is deleted from active systems, except for limited retention in backups, security records, or legal records as described in our Privacy Policy.

We do not use health information to train third-party general-purpose AI models, and we do not license it for that purpose.

8. Our service and intellectual property

Subject to these Terms, Fourth Labs gives you a personal, limited, revocable, nonexclusive, nontransferable right to use Fourth Health for its intended purpose.

Fourth Health's software, design, brand, educational content, and other materials—excluding your content and third-party materials—belong to Fourth Labs or its licensors. These Terms do not transfer ownership of them to you.

If you send suggestions or feedback, you allow us to use them without restriction or compensation, but you do not have to provide feedback.

9. Third-party information and services

Fourth Health may display clinician or practice information from public sources and Google Maps or Places. We do not verify that information. Confirm addresses, availability, credentials, services, and insurance participation directly with the practice.

Third-party services and links have their own terms and privacy practices. Fourth Labs is not responsible for a third party's independent service, content, or availability.

10. Changes, beta status, and availability

Fourth Health is early-stage software. Features may change, be unavailable, or be discontinued. We may correct errors, impose reasonable limits, or remove functionality.

If we discontinue the service, we will provide reasonable notice when practicable. We will make a reasonable effort to provide an export of user information when technically and legally feasible, but we cannot guarantee that every type of information will be exportable in every circumstance.

11. Account and household deletion

An account holder may request account deletion through available in-app controls or by contacting support@fourth-health.com. Account deletion and household deletion are separate:

  • Deleting an account removes that person's private information and access, subject to shared-record and legal exceptions.
  • A household administrator may be asked to transfer administration before deleting an account.
  • Deleting an account does not automatically delete a household administered by someone else.
  • An authorized administrator may separately request deletion of the household and shared household records.
  • Deleting a Fourth Health account does not automatically cancel a future subscription billed by Apple or another payment provider.

Fourth Health will explain the expected effect before confirming deletion. Additional detail appears in the Privacy Policy.

We may suspend or terminate an account for a material violation of these Terms, a safety or security risk, or a legal requirement. Where reasonable, we will provide notice and an opportunity to address the issue.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, FOURTH HEALTH IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT EXPRESS OR IMPLIED WARRANTIES.

We do not promise that Fourth Health will be uninterrupted, error-free, secure in every circumstance, or that its content, reminders, AI outputs, or third-party listings will always be accurate, complete, or current. We do not promise any particular health outcome.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FOURTH LABS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST GOODWILL, ARISING FROM FOURTH HEALTH.

To the fullest extent permitted by law, Fourth Labs' total liability for all claims relating to the service will not exceed the greater of the amount you paid Fourth Labs for the service during the 12 months before the claim or $100.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for gross negligence, willful misconduct, fraud, or other liability that applicable law does not permit us to limit.

14. Indemnification

To the extent permitted by law, you agree to reimburse Fourth Labs for reasonable losses and costs resulting from your unlawful misuse of Fourth Health, your material violation of these Terms, or your intentional provision of another person's information without authority. This does not require you to indemnify Fourth Labs for its own misconduct.

15. Disputes and governing law

If you have a concern, please contact support@fourth-health.com first so we can try to resolve it informally.

These Terms are governed by California law, without regard to conflict-of-law rules. Subject to rights you cannot waive under the law where you live, claims may be brought in an appropriate state or federal court located in San Francisco County, California, or in an eligible small-claims court.

These Terms do not require arbitration and do not waive either party's right to a jury trial or participation in a class action where those rights otherwise apply.

16. Apple terms

If you download Fourth Health through Apple's App Store, Apple's Standard Licensed Application End User License Agreement also applies unless Fourth Labs and Apple provide otherwise. These Terms are between you and Fourth Labs, not Apple. Fourth Labs, not Apple, is responsible for Fourth Health, support, and any claims concerning the service. Apple is a third-party beneficiary of this section and may enforce it.

You represent that you are not located in a country subject to a United States government embargo and are not prohibited from using the service under applicable sanctions laws.

17. General terms

  • Changes. We may update these Terms. We will update the date above and provide additional notice for material changes when reasonably required. Changes apply prospectively.
  • Electronic communications. You agree that we may provide service and legal notices electronically, including in the app or by email.
  • Severability. If a provision is unenforceable, the remaining provisions remain effective.
  • No waiver. A delay in enforcing a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent. Fourth Labs may assign them in connection with a merger, financing, reorganization, or sale of assets.
  • Entire agreement. These Terms and the policies incorporated above are the entire agreement about Fourth Health.
