Consumer health privacy

Consumer Health Data Privacy Policy

This policy describes how Fourth Labs, LLC ("Fourth Health," "we," "us," or "our") handles consumer health data. It supplements our general Privacy Policy.

Consumer health data we collect

Depending on the features you choose, Fourth Health may collect or infer:

  • Pregnancy, due-date, birth, postpartum, mood, symptom, recovery, blood-pressure, pulse, medication, meal, and appointment information
  • Infant feeding, pumping, sleep, tummy-time, diaper, health, and care information
  • Care-team and practice information linked to a household
  • Private Nell conversations and preparation-plan information
  • Nell-generated summaries, signals, relevance selections, and action proposals
  • Information about how household members interact with shared care records and health-related educational content

We do not collect precise GPS location and do not use geofences around healthcare facilities.

Sources of consumer health data

We collect consumer health data from:

  • You, when you create an account, complete a profile, upload a photo, write a note, use a tracker, search for a practice, or talk with Nell
  • Other adults in a household, when they add information to the shared household at the invitation of an authorized caregiver
  • Your use of Fourth Health, such as saved or completed educational content and confirmed Nell actions
  • Inferences created by Nell from information available to your account, such as a mood or recovery signal
  • Public practice information and Google Maps or Places results when you search for or link a care provider

Why we collect and use consumer health data

We collect and use consumer health data to provide features you request, including:

  • Recording and displaying care information, timers, schedules, reminders, and plans
  • Coordinating care within a household you create or join
  • Providing Nell conversations, relevant context, summaries, signals, and user-confirmed actions
  • Showing relevant Fourth Health educational content
  • Providing support, protecting accounts and households, diagnosing problems, and complying with law

We do not use consumer health data for targeted advertising, and we do not sell it.

Consumer health data we share

At your direction, shared household information is disclosed to the adults invited into that household. This may include pregnancy, postpartum, medication, symptom, meal, care-team, and infant-care information. Private Nell conversations remain visible only to the account that created them. Mood and recovery signals are disclosed to household members only after the account owner explicitly enables sharing.

We also disclose consumer health data to processors that help us provide the service:

We may also disclose information when required by law or reasonably necessary to protect safety, security, or legal rights. We do not permit a third party to collect consumer health data over time across unrelated websites or services for targeted advertising through Fourth Health.

Consent and your choices

Fourth Health collects and uses consumer health data when necessary to provide a feature you request. We will seek additional, affirmative consent before using or sharing consumer health data for a materially different purpose.

You direct household sharing by creating or joining a household and using shared features. You can stop a household member's future access if you are authorized to manage that household. You direct Nell processing by choosing to start or continue a Nell conversation. Mood and recovery signal sharing is off by default and requires a separate choice.

Withdrawing consent may prevent a feature from working. Withdrawal does not affect processing that occurred before withdrawal or information another household member already saw or independently saved.

Your consumer health data rights

You may request:

  • Confirmation of whether we collect, use, or share your consumer health data
  • Access to the consumer health data associated with your account
  • Correction of inaccurate consumer health data
  • A portable copy where technically feasible and required
  • Deletion of consumer health data associated with your account, subject to shared-household and legal exceptions
  • Withdrawal of consent for optional collection or sharing
  • A list of third parties and affiliates with whom your consumer health data has been shared, where required by law

Send a request to support@fourth-health.com using the email associated with your account. We may verify your identity and your authority over an account, household, or child's record.

If we deny a request, you may appeal by replying to the decision or emailing support@fourth-health.com with the subject Consumer Health Data Appeal. We will respond within the time required by applicable law and explain how to contact the appropriate regulator if an appeal is denied.

Deletion

Account deletion and household deletion are separate because household records may include several people's contributions. We will explain the expected effect before confirming a deletion. When we approve a valid deletion request, we will delete the relevant consumer health data from active systems and instruct processors to do the same, subject to information that must remain for another authorized household member or that may legally be retained.

Information in backups will be deleted, overwritten, or rendered inaccessible and scheduled for deletion under our providers' backup cycles. It will not be restored to active use except when needed for security, legal compliance, or disaster recovery.

Security

We maintain administrative, technical, and organizational safeguards appropriate to the sensitivity of consumer health data. These include encrypted connections, provider encryption for stored data, database row-level security, household-scoped authorization, private file storage, and restricted access.

Changes to this policy

We will update the date above when this policy changes. We will provide additional notice and obtain consent when required before collecting, using, or sharing new categories of consumer health data or using existing data for a materially different purpose.
